Jim Wright Obtains Award of Almost $80,000 in Sanctions against Motor Vehicle Lawsuit Plaintiff

In December, we reported that Zausmer shareholder James Wright obtained a significant win on behalf of an insurance carrier in a first-party auto negligence trial.

Following that courtroom victory, the presiding judge entered an order granting case evaluation sanctions against the plaintiff in favor of Jim’s client.

In the underlying case, the plaintiff sued her insurance carrier to recover no-fault PIP benefits she claimed to have sustained in an automobile accident. Through her attorney, she demanded nearly $400,000 in damages with a total exposure of $520,000.

The plaintiff repeatedly declined offers to settle the matter, and her rejection of a case evaluation award later triggered a court rule provision allowing the court to impose sanctions against her after Jim convinced the jury to return a no-cause verdict at trial.

Granting Jim’s post-trial motion, Judge Joseph Toia of the Macomb County, Michigan Circuit Court entered an order awarding nearly $80,000 in attorney fees and costs to our client.
